Acacia Circles and Vista Verde Circles

At the March 18, 2015 Council Meeting, the Mayor and Council requested that I provide estimated fees and construction costs to facilitate conveyance of the five (5) existing Peninsula HOA tracts to the City as right-of-way.


The following are the estimates pursuant to the request:

1.    City Engineer — $15,000

  • Obtain Title Reports
  • Research deeds and record property data
  • Provide field survey to create boundaries for the portion to become rights-of-way
  • Prepare a Map of Dedication
  • Coordinate and meet with the City Manager, City Attorney and other Staff
  • Coordinate with the HOA during the election and Board approval process
  • Attend two (2) HOA meetings
  • Attend Council Meeting when conveyance is considered

2.    City Attorney — $2,000

  • Process/monitor title insurance, which will be paid by the HOA, through the close of escrow
  • Consult with the HOA attorney, who will advise of the process/authority for dedication of the property to the City
  • Review the dedication documents
  • Although no dedication agreement is required, instructions to the title company will be prepared
  • Provide a policy for acceptance of property for dedication

3.    Milling and Paving Improvements Project Cost — $182,000

  • FY 2015 Pavement Maintenance Program including milling of pavement and placement of new asphalt

The total estimated costs related to the conveyance of five (5) existing HOA tracts to the City is $199,000 for services by the City Engineer and City Attorney, and the resurfacing of said streets.

Staff’s findings are that the five (5) existing HOA tracts always have been treated as public streets and are not designed in such a manner as to indicate that the circles were ever intended to be private driveways or roads.  The City has always maintained the circles as public right-of-way, as the circles serve multiple individually owned residential units.  The circles were never intended to restrict public access to the residential units in the respective circles.

This matter will be on the April 15, 2015 agenda for discussion and possible direction to Staff and/or action. 

Purchase of 16.67 Acres from Dragon & Crane

We are proceeding with the required schedule of acts to be in compliance with the Purchase Agreement to secure the property to be purchased by the City of Litchfield Park from Dragon & Crane.

The following is a brief summary of action thus far:

  1. Purchase Agreement signed by parties on March 20, 2015
  2. Western Technologies contracted to conduct a Phase I Environmental Study of the property on March 24, 2015
  3. Escrow opened on March 25, 2015
  4. Earnest money deposit of $50,000 by City on March 31, 2015
  5. Preliminary Title Report has been received
  6. ALTA Survey ordered on April 9, 2015
  7. Phase I Environmental Study Assessment completed on April 10, 2015.  Per the findings of the Assessment, a Phase II Environmental Study Assessment is not required. 

The Close of Escrow is scheduled for June 15, 2015.
